Squadra Avocats advised the B-GO group, which operates restaurants of the American Carl’s Jr brand in France through several subsidiaries, on the adoption of its reorganisation plans. In six judgments handed down on 22 September 2026, the Aix-en-Provence Commercial Court approved the plans of the group and its subsidiaries, allowing the business to continue and preserving 133 jobs.
Owned by the holding company Brescia Investissement, the B-GO group had been placed in receivership (redressement judiciaire) in November 2024. With no buyer forthcoming, it presented continuation plans that were put to a vote of its creditors, grouped into classes of affected parties. Approved by a majority of the classes, the plans were then imposed by the Commercial Court on the other creditors.
The plans provide for the repayment of debts over nine years. The franchisor, CKE, is waiving half of its claim, and the shareholders are waiving all of the sums they had advanced to the group.
Squadra Avocats advised on the entire process with a team comprising Charles Morel (Partner, Restructuring) and Victoria Knafo (Lawyer).
The B-GO group was also advised on financial matters by 8 Advisory (Axel Raubert and Paul Houeix).
The proceedings were conducted by Ajilink, court-appointed administrator, with Frédéric Avazeri and Romain Tarrade, and by Vincent de Carrière, creditors’ representative (mandataire judiciaire).
CKE, owner of the Carl’s Jr brand, was advised by DLA Piper (Sandra Esquiva Hesse and Marin Ploix).
SNCF Gares & Connexions, a strategic partner of the group, was advised by Osborne Clarke (Alexandre Le Mière, Nassim Ghalimi and Paul Lafuste).
